Update your FDA Export Listing Module (ELM) facility registration for market access to China.


As part of the U.S.-China economic and trade agreement signed yesterday, China has agreed to: 

  • Recognize the U.S. dairy-safety system as providing at least the same level of protection as China's dairy-safety system.
    • Along these lines, the current requirement for an audit every two years by a third-party certifier is expected to be removed, pending official confirmation.
    • Moreover, the "high-risk" questionnaire requirements for fluid milk producers to obtain their facility registration is eliminated.
  • Allow imports of U.S. dairy products that are manufactured at a facility on a list compiled by the FDA.
    • Upon receiving the list from FDA, the General Administration of Customs (GAC) in China shall update/publish this list within 20 business days and allow U.S. dairy imports into China from those facilities.
    • Market access has expanded to allow extended shelf life (ESL) milk, fortified milk, and ultra-filtered milk produced in the U.S. to be imported and sold in China.

As such, we urge all members to review and update your facility registration on the FDA's FURLS Export Listing Module (ELM) before January 31st as this Agreement enters into force on February 14, 2020.
