European Union Applies Additional 25% Retaliatory Tariff on Imports of Multiple U.S. Dairy Products

Following the World Trade Organization's authorization of $4B in retaliatory tariffs as part of the Boeing aircraft subsidies case and despite the fact that the U.S. has eliminated the subsidies deemed to violate WTO rules, the European Union implemented retaliatory tariffs against a variety of U.S.-origin imports effective today, Tuesday, November 10, 2020. Please note that the retaliatory tariffs will not be applied to products which either had an import license granted earlier in the year or were exported from the U.S. before today, November 10, 2020.

Several dairy-related product categories are included among the HS codes impacted by the retaliatory tariffs and will now have an additional 25% retaliatory tariff rate applied to them. These are:

Cheese

  • 0406.10.50: fresh cheese "unripened or uncured cheese", incl. whey cheese and curd of a fat content, by weight, of <= 40% (excl. mozzarella)
  • 0406.90.21: cheddar (excl. grated or powdered and for processing)
  • 0406.90.86: cheese, of a fat content by weight of <= 40% and a water content, by weight, of non-fatty matter of > 47% but <= 52%, n.e.s

Chocolate and other food preparations containing cocoa, in blocks, slabs or bars

  • 1806.20.10; 1806.20.30; 1806.20.50; 1806.20.95

Sauces and preparations

  • 2103.90.90: Sauces and preparations therefor; mixed condiments and mixed seasonings

Milk protein concentrate

  • 3504.00.10: concentrated milk proteins with a protein content > 85% by weight, calculated on the dry matter
  • 3504.00.90: peptones and their derivatives; other albuminous substances and their derivatives, n.e.s.; hide powder, whether or not chromed (excl. concentrated milk proteins with a protein content > 85% by weight, calculated on the dry matter
